Terms of Service

Last updated 18 October 2026

About these terms

These terms apply to this website and to the services provided by Digimate (ABN 47 620 803 217), referred to as “we” and “us”. When you accept a quote or proposal from us, these terms and that quote together form our agreement with you.

If the quote and these terms disagree, the quote applies. If you do not agree with these terms, please do not use our services.

Quotes and scope

Every quote sets out what we will do, what it costs and roughly when. A quote is valid for the period stated on it, or 30 days if none is stated.

Work outside the quote is quoted separately. We will not start it until you agree.

Fees, GST and payment

Prices are in Australian dollars. Your quote shows whether GST is included. Invoices are due within 14 days unless the invoice says otherwise.

Projects may be invoiced in stages or with a deposit, as set out in the quote. Monthly plans are invoiced as set out in the quote. If an invoice is overdue, we may pause work after giving you reasonable notice.

Ad budgets and third-party costs

Ad budgets are paid directly to the advertising platforms, such as Google and Meta, and are separate from our fees. We will not spend more than the budget you have agreed.

Other third-party costs, such as domain names, hosting, software subscriptions, stock images and printing, are listed in the quote. We will tell you before we commit you to any new cost.

What we need from you

To do the work on time, we need access to your website, accounts and tools, the information and materials we ask for, and prompt feedback and approvals. Delays on your side can move our timeline.

You confirm that you have the right to give us any text, images, logos or data you supply, and that they do not infringe anyone else's rights.

Approvals

You approve content, ads and designs before they go live, unless the quote says we can publish routine updates without approval. Changes after you have approved something may be quoted as extra work.

Results

SEO, advertising, social media and AI tools depend on many things we do not control, such as search engine and platform changes, competitors, budgets and how quickly you respond to enquiries. We do not promise rankings, leads, sales or mentions in AI tools.

We do promise to do the work carefully, to explain what we are doing, and to report honestly on what happened.

Ownership

Once you have paid in full, you own the final website, content, designs and other deliverables we create for you. Your domain, ad accounts, social accounts and data are yours and stay in your name.

We keep ownership of our own tools, templates, methods and know-how. Fonts, plugins, stock images and other third-party material stay under their own licences. We will not publish your name or work as a case study without your permission.

Accounts and access

Where possible, accounts are set up in your name and you give us access to work in them. You can remove our access at any time. We keep your logins secure and use two-factor authentication where it is available.

You are responsible for following the terms of the platforms you use, such as Google, Meta, LinkedIn and TikTok.

Confidentiality and privacy

We keep your business information confidential and use it only to deliver the services. We handle personal information in line with our Privacy Policy.

AI tools

We use AI tools in our work and review what they produce. AI tools can make mistakes. When we set up an AI receptionist, assistant or automation, we test it with you before it goes live and check it regularly, but we cannot promise it will never give a wrong answer.

You remain responsible for decisions in your business, and for following the laws that apply to you, including advertising, privacy and call recording rules. Where a service involves confidential information, we agree with you which tools are suitable.

Ongoing services and cancelling

Ongoing services, such as SEO, ads management, social media and website maintenance, continue month to month unless your quote says otherwise. You can cancel by giving the notice period stated in the quote.

If you cancel a project, you pay for the work done up to that point and any third-party costs we cannot get back.

If something goes wrong

We may pause or end the services if an invoice stays unpaid after reasonable notice, if you break these terms, or if the work would break the law or a platform's rules. We will tell you why.

If you are unhappy with something, tell us early and we will work with you to fix it.

Liability

Nothing in these terms limits any rights you have under the Australian Consumer Law or other laws that cannot be excluded.

To the extent the law allows, our liability for a problem with a service is limited to supplying the service again or paying the cost of having it supplied again. We are not liable for indirect or consequential loss, including lost profit or lost opportunity.

Using this website

The information on this website is general information, not professional advice. Please do not misuse the website, try to break its security, or copy its content for commercial use without our permission. Links to other websites are provided for convenience, and we are not responsible for their content.

Changes to these terms

We may update these terms from time to time. The latest version is always on this page. For work already agreed, the terms in force when you accepted the quote continue to apply unless we both agree to change them.

Disputes and governing law

If we disagree about something, please contact us first so we can try to sort it out. These terms are governed by the laws of Western Australia, and both of us submit to the courts of Western Australia.
